DUBLIN, IRELAND (January 18, 2026) — It’s been a long winter with Notre Dame and the Giants out of the playoffs. At least my Leinster Rugby team is a top seed in their pool in the Investec Champions Cup but as 4th overall they are only guaranteed one home game. On the upside I got tickets to 2 of the 3 home games for the Six Nations (Wales, Italy).
It is now three weeks since New Rochelle was required to respond to my Article 78 about the Bob Young reply to the Flowers Park RFP and five weeks since I filed and served City Manager Wilfredo Melendez and the City of New Rochelle.

Part XVI tells how a New Rochelle mother is suing for a $12,627.50 refund for unearned prepaid tuition. Despite the business's handbook allowing refunds with 60 days' notice—and Rubicco's verbal/email confirmations—he has refused to pay unless Junuz signed a non-disparagement agreement and a confession of judgment (a legal tool allowing immediate judgment without defense typically required of the debtor not by the debtor. The suit (filed August 9, 2024, Westchester Supreme Court, index 67023/2024) claims breach of contract, unjust enrichment, and account stated. Defendants' failure to timely answer led to a motion for default judgment (filed November 2025), with a hearing set for March 13, 2026, before Judge Robert S. Ondrovic.
Part XVII a Darien, CT foster parent sued to recover a $2,340 security deposit paid for summer 2020 daycare services for two foster children (intended as the final month's payment at $1,200 per child/month for three days/week). After discovering payments would come from out-of-state foster offices, the daycare allegedly sought a fee increase; when the foster mom rejected it, the children's attendance was terminated, and the deposit was withheld. The claim was filed in March 2021 (docket FST-CV21-6050927-S, Stamford/Norwalk Superior Court). Defendants denied liability, counterclaimed ~$4,500 for alleged "false claims" (denied by plaintiff). At the August 2, 2021 remote trial, Schimmeck testified credibly, but no one from the daycare (including Rubicco) appeared. Judge Trial Referee Tagart D. Adams ruled in her favor on August 3, awarding the $2,340 deposit plus 6% interest for one year and costs. The judgment remains unpaid after over five years, with no satisfaction recorded. Rubicco referenced a questionable "attorney" (Lance Orbe via Gmail), but no evidence confirms legitimacy.
Part XVIII The New York State Workers’ Compensation Board enforced the penalty for the employer's failure to maintain workers’ compensation insurance from December 31, 2013, to February 7, 2014, violating New York Workers’ Compensation Law. A final demand notice for $3,000 payment to the Uninsured Employers Fund was sent by certified mail on February 2, 2015.,After non-payment (confirmed by attorney James R. McGinn's affirmation), and exhaustion of appeals, a judgment was entered on March 11, 2015, in Westchester County Supreme Court (Index #53630/2015). This allows asset seizure or garnishment. No record shows payment.
