I Asked an Appeals Court to End New Rochelle’s Shrub Oak Secrecy Delay
DUBLIN, IRELAND (October 23, 2026) — After a full day preparing my response to the district’s appeal, the next decision belongs to the Appellate Division.
I spent most of today, preparing and submitting an 18-page court filing in my continuing legal battle with the City School District of New Rochelle over its legal bills related to Shrub Oak International School
If you’ve been following this story, you’ll know that I won an Article 78 proceeding in Westchester County Supreme Court. Justice Sheralyn Pulver ruled that the school district could not withhold the information I had requested under New York’s Freedom of Information Law (FOIL) in the manner it had attempted.
The district appealed. Under New York law, that appeal triggered an automatic stay of the judgment, meaning the district does not have to comply with Justice Pulver’s order while the stay remains in effect.
I filed a motion asking the Appellate Division, Second Department, to lift that stay. The district opposed my motion on October 19. Friday’s filing was my reply to its opposition.
